Wedding Photographer Contract

We request that Cynthia Smith, PhotoSmiths Photography, to be our exclusive and official wedding photographer, and we agree to recognize and abide by theses policies identified below. We understand that:

ENTIRE AGREEMENT: This agreement contains the entire understanding between PhotoSmiths Photography and the CLIENT. It supercedes all simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all parties. If parties want to waive on provision of this agreement that does not mean that any other provision is also waived. The party against who a waiver is sought to the effective must have signed a waiver in writing.

RESERVATION: A signed contract and retainer fee are required to reserve the specified coverage.

PRE-EVENT CONSULATATION: The parties agree to a pre-even consultation no later than two weeks before the event date in order to finalize the actual shooting times. Locations and CLIENT?S checklist (in writing) for specific photographs. The bride and groom agree to set aside at least one hour of time that ends � hour before the wedding ceremony commences and a 45-minute time frame afterward for photographs that cannot be obtained during the wedding. If the bride?s or groom?s late arrival or the late arrival of any member of the wedding part prevents a full hour from occurring the photographer shall not be held liable for failure to take desired photographs.

COOPERATION: The parties agree to cheerful cooperation and communication for the best possible result within the definition of this of this assignment. PhotoSmiths Photography recommends that CLIENT designates an ?event guide? to point out important individuals for informal or candid photographs to the photographer during the wedding that they wish to have photographed. The photographer will not be held accountable for not photographing desired people if there is no one to assist in identifying or gathering people for photographs.

SHOOTING TIME / ADDITIONS: CLIENT and PhotoSmiths Photography agree that cheerful cooperation and punctuality are essential. Shooting commences at the scheduled start time.

LOW LIGHT: Although romantic, a candlelight or low light ceremony normally does not provide enough ambient light for the camera to work, even with flash. There must be enough light for the photographer to see the subject and adjust the focus before taking the pictures. PhotoSmiths shall not be held accountable for unacceptable images resulting from a dark ceremony.

HOUSE RULES: The photographer is limited by guidelines of the ceremony official or reception site management. Negotiation with officials for moderation of guidelines is CLIENT?s responsibility; PhotoSmiths can only offer technical recommendations.

COPYRIGHTS: The photographs produced by PhotoSmiths are protected by the Federal Copyright Laws, (all rights reserved) and may not be reproduced in any manner without PhotoSmiths explicitly written permission.

EXHIBITIONS: CLIENT grants PhotoSmiths Photography permission to display selected images resulting from this assignment as an example of PhotoSmiths work and for entrance into photographic competitions and releases all claims to profits that many arise from use of images.

MODEL RELEASE: The CLIENT herby grants to PhotoSmiths and its legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs of CLIENT or in which the CLIENT may be included for editorial, trade, advertising and any other purpose and in any manner and medium; to alter the same without restriction; and copyright the same. The CLIENT herby released PhotoSmiths and its legal representatives and assigns from all claims and liability relating to said images.

LIMIT OF LIABILITY: In the unlikely event that the photographer is injured or becomes too ill to photograph the event, PhotoSmiths Photography, will make every effort to secure a replacement photographer. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the event package. PhotoSmiths Photography takes the utmost care with respect to the transportation and processing of images. However, in the unlikely event that the images have been lost, stolen or destroyed for reasons wit or beyond PhotoSmiths control, PhotoSmiths Photography liability is limited to the return of all payments received for the event packages. The limit of liability for a partial loss of originals shall be prorated amount of the images lost based on the percentage of total number originals.

SECURITY DEPOSITS: In the even of cancellation by CLIENT, the retainer fee paid is non-refundable. It shall be liquidated damages to PhotoSmiths Photography in the even of a breach by contract by CLIENTS. The CLIENT shall also be responsible for payment for any PhotoSmiths materials charges incurred up to the time of cancellation.

COMPLETION SCHEDULE: CD, DVD, prints or album delivery requires about three to four weeks from the wedding date.

PAYMENT SCHEDULE: A 25% retainer fee reserves your wedding date and is deducted from the total cost. Balances payable in full of the day of your wedding.
